NEURIGHTS AND THE EXPANSION OF DATA PROTECTION CIRCLES

RECOGNITION OF THE HIDDEN UNVEILED FROM NEUROTECHNOLOGIES

Abstract

Uncovering the human mind means having access to what is most hidden in the human being, and that time is probably close, given the development of neurotechnology. The objective of this study is to indicate that neurorights, a new legal branch, are essential instruments of protection, regulation and delimitation for the development of this type of technology. It is suggested that for better protection of neural data, a new protection circle be created, the Hidden, from the didactic perspective of the Theory of Concentric Circles. The work is justified by the hypervulnerability to which human beings will be exposed, since their data may be accessed, stored and sold without their consent. Two theoretical references are present in the research that aim to construct the Theory of the Hidden: a) Theory of Concentric Circles, which exposes the emergence of a new sphere of protection; b) reflections on technique supported by Martin Heidegger. The envisaged conclusion indicates that neurolaw is the appropriate discipline to regulate the use of technologies that impact the human mind and the data it stores. The chosen method was hypothetical-deductive and the technique for data collection was bibliographic literature review.
