Transparência e avaliação de impacto algorítmico no uso da IA no Poder Judiciário

This article analyzes the use of Artificial Intelligence (AI) in the Brazilian Judiciary under CNJ Resolution No. 615/2019, focusing on transparency, governance, and algorithmic impact assessment. Based on data from the National Council of Justice (CNJ), 140 AI projects were mapped by 2023, distributed across different development stages, but only 13.57% were formally registered on the Sinapses Platform. This discrepancy reveals a critical governance gap, undermining oversight and compliance with regulatory standards. The results show that AI adoption is uneven among courts and branches of the Judiciary, reflecting budgetary constraints, lack of specialized teams, and regional disparities. From a legal perspective, the absence of registration and impact assessment may jeopardize constitutional principles such as transparency, equality, and non-discrimination. The study concludes that the quantitative expansion of AI must be accompanied by robust governance and audit mechanisms to align technological innovation with the protection of fundamental rights.
