Artificial intelligence and telework in the Judiciary
regulatory challenges and impacts on mental health

This study examines the intersection between telework and artificial intelligence within the Judiciary, emphasizing the regulatory challenges and mental health impacts affecting judicial workers. Based on the legal framework established by Articles 75-A to 75-F of the Brazilian Consolidation of Labor Laws (CLT) and the National Council of Justice (CNJ) Resolution No. 615/2025, it investigates how the ethical and transparent use of AI can help mitigate psychosocial risks arising from intensified remote work. The article proposes the creation of an occupational artificial intelligence layer, designed to detect collective patterns of work overload and support institutional mental health policies, without resorting to individual surveillance. The research adopts a qualitative and interdisciplinary approach, grounded in authors such as Dejours (2008), Antunes (2020), and Filho and Lucca (2024), as well as the International Labour Organization (2020) guidelines. It concludes that the digital transformation of the Judiciary will only be legitimate if it aligns technological efficiency with the integral protection of human dignity.
