Artificial intelligence in the Brazilian Judiciary
between technological innovation and the protection of fundamental rights

The use of artificial intelligence (AI) in the Brazilian Judiciary has become a key strategy for institutional modernization, aimed at increasing efficiency, productivity, and consistency in judicial decisions. AI-based tools, such as the Athos system developed by the Superior Court of Justice (STJ), represent a significant advance in streamlining judicial activities by improving case screening and jurisprudential research. However, the implementation of such technologies raises ethical and legal concerns regarding transparency, bias mitigation, and the preservation of judicial autonomy. In this context, the theme of this study is the use of artificial intelligence in the Brazilian Judiciary, and the research problem concerns the analysis of the limits and potentialities of this technology in light of the National Council of Justice (CNJ) Resolution No. 615/2025, particularly regarding the balance between technological innovation and the protection of fundamental rights. The general objective is to examine the operation and impacts of the Athos system within the STJ, assessing its contribution to efficiency without undermining democratic principles. The methodology is based on the deductive method, using bibliographic and legislative research and a qualitative data approach.
